Squirrels LLC (referred to in this Privacy Policy as "Squirrels," "we," "us" or "our"), is committed to protecting the privacy of all individuals who use and register to use our products and services related to ClassHub (referred to in this Privacy Policy as "ClassHub Service") and who visit our websites related to ClassHub (the “ClassHub Website") which Website are separate and distinct from the Products & Services provided to you). This Privacy Policy describes our privacy practices and how we use and collect the personal information, including personally identifiable information (referred to in this Privacy Policy as "personal information") that you share with us when using our ClassHub Products & Services and when browsing our ClassHub Website.

Please read the following privacy terms carefully. If you use Squirrels' ClassHub Products & Services or Squirrels' ClassHub website, you are deemed to agree and accept these terms even if you did not take any other specific action expressly indicating your acceptance of such terms. If you do not agree to these terms, please stop using Squirrels' ClassHub Products & Services and the ClassHub Website.

INTERNATIONAL USE & SAFE HARBOR STATEMENT

Squirrels is headquartered in the United States of America. Therefore, personal information that we collect and maintain may be transferred to or controlled and processed in the United States of America and/or other countries around the world. By providing us with personal information and by using the ClassHub Website and ClassHub Products & Services, you consent to this transfer. We will protect the privacy and security of personal information we collect in accordance with this Privacy Policy, regardless of where it is processed or stored; however, you explicitly acknowledge and consent to the fact that personal information stored or processed in the United States will be subject to the laws of the United States, including the ability of governments, courts, law enforcement and/or regulatory agencies of the United States who have valid jurisdiction over Squirrels to obtain disclosure of your personal information subject to a valid subpoena, court order or similar official request.

HOW AND WHEN INFORMATION IS COLLECTED

Squirrels collects and uses the personal information that you proactively provide to us when you:

  • Register an account with us to use any of our ClassHub Products & Services on a paid, free or trial basis;
  • Register for any webinars, seminars or similar online programs or events hosted or sponsored by Squirrels;
  • Enter any of our contests, sweepstakes or other promotions;
  • Respond to any Squirrels surveys, emails, questionnaires or similar online forms

For ClassHub Products & Services, Squirrels will use the following means to collect some or all of the personal information from:

  • Squirrel's integration with, and downloads from, a third party provider—e.g., Clever Inc., Google, Apple, or Microsoft;
  • Local schools, districts, administrators, and/or boards of education (referred to in this Privacy Policy as “Education Entities") when they establish an account with Squirrels; or
  • On possible limited occasions, directly from teachers, students, and/or end users (some of whom may be under the age of 13):

Through these means, Squirrels may collect some or all of the following information: first name; middle name; last name; email; date of birth; grade; name prefix; name suffix; photo; student number; teacher number; and student and/or teacher titles.

Some of the personal information collected and maintained allows teachers to connect and monitor students' electronic devices. Local schools, districts, administrator, and boards of education (referred to in this Privacy Policy as “Education Entities") may provide us with personal information to help facilitate registration with our ClassHub Products & Services.

In addition, generally, you can browse through our ClassHub Website without providing us with any personal information about yourself. However, as you navigate through our ClassHub Website and/or use our ClassHub Products & Services, certain personal information, some anonymous, may be passively collected (that is, gathered without your actively providing the information) using various technologies, such as cookies, unique IDs, Internet tags, web beacons, and navigational data collection (log files, server logs, clickstream). Your internet browser automatically transmits some of this anonymous information, such as the URL of the website you just came from and the Internet Protocol (IP) address and the browser version your computer or mobile device is currently using; the date and time you access the ClassHub Website and the pages that you access while at the ClassHub Website.

This information is used by us for internal business purposes, to analyze trends and to improve upon our ClassHub Website and ClassHub Products & Services. Other anonymous information may be collected from your computer or mobile device through tracking technologies that we employ on our ClassHub Website such as cookies, unique IDs and internet tags or web beacons. The use of cookies and technologies is explained more fully below. You may set your browser to notify you when a tracking cookie is sent or to refuse cookies altogether, but please be aware that certain features of our ClassHub Website and ClassHub Products & Services may not work without cookies enabled.

INFORMATION FROM OTHER THIRD PARTIES

We also may receive personal information from our business partners and vendors including, but not limited to, Clever Inc., Apple, Google, and Microsoft. We maintain this personal information in accordance with applicable laws, acceptable privacy practices consistent with this Privacy Policy, and, if applicable, the terms of a contract between Squirrels and an Education Entity.

OUR USE OF COOKIES AND TRACKING TECHNOLOGIES

Squirrels uses cookies to help us track and analyze user traffic patterns. A "Cookie" is a small data file that certain websites write to your computer when you visit them. Cookies cannot be used to run programs or deliver viruses to your computer. A cookie file can contain information such as a unique user ID that a website uses to track the pages you've visited, but the only personal information a cookie can contain is information you elect to supply yourself. A cookie can't read data off your computer or read cookie files created by other websites. Cookies can help save you time, for example, if you personalize a web page, or navigate within a website, a cookie recalls your specific information for future visits. In addition to cookies, our ClassHub Website use a variety of other methods and tools for tracking purposes, including Internet tags and web beacons, which are small pieces of data that are embedded in images and pages of our ClassHub Website. While most web browsers automatically accept cookies, many browsers allow you to modify your browser setting to decline cookies and/or "opt-out" of tracking technologies. Please note, however, if a visitor turns off cookies, such visitor may find some of the functionality of our ClassHub Website and/or our ClassHub Products & Services, to be reduced or impaired. We also utilize both proprietary and third party analytics tools, such as Google Analytics, to gather information designed to help us gain insight into how visitors interact with and use our ClassHub Website and ClassHub Products & Services. You can prevent your data from being collected by Google Analytics on our ClassHub Website by installing the Google Analytics opt-out browser add-on. We may also use certain Google Analytics Advertising features which provide interest-based ads based on your visit to our ClassHub Website or other websites. You can manage the Google ads you see and opt-out of interest-based ads through Google's Ad Settings. Based on our knowledge, third party analytics software will not share your personal information or associate your personal information with any other data held by such software.

HOW WE USE INFORMATION COLLECTED

Squirrels uses the personal information we collect for our own general business purposes, which may include:

  • to operate the ClassHub Products & Services and ClassHub Website we provide;  to analyze, research, report on, maintain, develop, support, diagnose, and improve upon the ClassHub Products & Services and ClassHub Website we provide;
  • to fulfill your requests and/or orders for certain ClassHub Products & Services, as well as administration services and support;
  • to help facilitate the creation of your account;  to identify you on our system;  to keep you up-to-date on our latest product updates, announcements, notifications, and special offers.
  • for research and data modeling purposes;  to allow or improve operability and functionality within a classroom or school;  to allow you to send us communications and inquiries, which may require a response
  • from us; however, you may opt out of receiving these communications at any time (see "Choice/Opt-Out" below);
  • to provide students, teachers, and Education Entities with information in furtherance of K–12 school purposes; and
  • to personalize your experience with our ClassHub Products & Services;

Squirrels complies with the Family Educational Rights and Privacy Act (“FERPA") as to the use and disclosure of personal information. In addition Squirrels does not:

  • use the personal information created or gathered through the use of its ClassHub Products & Services to engage in targeted advertising through the ClassHub Products & Services; or targeted advertising on any other site, service, or application;
  • use personal information, created or gathered on the ClassHub Website or through the use of its ClassHub Products & Services, to amass a profile about a K–12 student except in furtherance of K–12 school purposes or as disclosed in this Privacy Policy or permitted under applicable law; or
  • sell any personal information of a student pursuant to applicable laws.

INFORMATION SHARING AND DISCLOSURE

Squirrels will not transfer your personal information to third parties, except as described in this Privacy Policy. We may transfer your personal information, without your consent, in the following circumstances: (i) to conform to the edicts of law or comply with legal or judicial process served on Squirrels; (ii) to protect or defend the rights or property of Squirrels; (iii) to protect the personal safety, property, or privacy of Squirrels' employees, users of Squirrels' ClassHub Products & Services, or members of the public; (iv) to ensure legal and regulatory compliance, or to take precautions against liability or (v) if Squirrels is acquired by or merged with another company, if substantially all of Squirrels' assets are transferred to another company,or as part of a bankruptcy proceeding, in which case, we will notify you via email or on our ClassHub Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information. If you choose to provide us with your personal information, we may transfer that information within Squirrels or to Squirrels' third parties with your permission or as allowed under applicable law. In particular, Squirrels may send your personal information to other companies or people under any of the following circumstances: when we have your consent to share the information; we need to share your information to provide the ClassHub Products & Services you have requested; we need to send the information to companies who work on behalf of Squirrels to provide the ClassHub Products & Services to you (we will only provide those companies the information they need to deliver the service, and they are prohibited from using that information for any other purpose other than those specified in this Privacy Policy or any contract between Squirrels and an Education Entity); or we want to keep you up to date on the latest product announcements, software updates, special offers or other information we think you'd like to hear about either from us or from our business partners (unless you have opted out of these types of communications). In addition, we may share non-identifiable aggregate personal information about our users (for example, the proportion of male and female users) with advertisers, business partners, and other third parties in an effort to customize or enhance the content and advertising on our ClassHub Website for our users.

OPT-OUT

Unless you take action to "opt-out" of receiving marketing and promotional materials at the point of data collection, it is deemed that you have given us your consent to collect and use your information in accordance with this Privacy Policy. You must "opt-out" to indicate that you are refusing or revoking your consent to use your personal information for the purposes covered in this Privacy Policy. You may indicate your desire to "opt-out":

  • when you receive marketing and promotional communications from us by clicking the "unsubscribe" hyperlink and following the instructions;
  • at any time by sending an email request to support@classhub.com (please indicate “Opt-Out" in the subject line); or
  • by sending a written request to our address as provided below under the section titled "Contact Us" You may also stop the collection of personally identifiable information in connection with your use of our ClassHub Products & Services by stopping your use of them.

YOUR ABILITY TO REVIEW AND DELETE INFORMATION

You can always ask to review any personal information, including personally identifiable information, that Squirrels has collected, and have us update, correct, or delete this information from the data systems maintained by us, and/or instruct us not to use this information in the future. If you wish to exercise this right, simply contact us (see below). Please note that any personal information updated, corrected, or deleted by Squirrels will only apply to the personal information maintained in Squirrels' data systems and will not update, correct, or delete information maintained and stored with third party providers including, among others, Clever Inc., Google, or Microsoft. Squirrels has no control of, and is not responsible for, the data maintained and stored by third party providers. Your personal information maintained by third party providers, including any updates, corrections, or deletions to such personal information, is your responsibility and not Squirrels' responsibility. When Squirrels downloads information from a third party provider (which typically is done every semester or school year), any personal information maintained on Squirrels' data systems from a prior download from that third party provider, will be replaced with the personal information from the new download. It is important to note the risk that personal information maintained by a third party provider that is not updated, corrected, or deleted directly with such third party provider could be downloaded again by Squirrels onto its data systems in the future. If that occurs, you will be required to contact Squirrels again to request the personal information be updated, corrected, or deleted as set forth in this Privacy Policy.

RETENTION OF INFORMATION

Generally, we retain personal information collected, generated, or inferred for as long as an account is active or as needed to provide the ClassHub Products & Services. If a contract exists between Squirrels and an Education Entity, we retain such personal information until the time period specified in a contract or, if it is not specific in the contract, we destroy the information when the information is no longer needed for the purpose of such contract. In addition, during the term of a contact between Squirrels and an Education Entity, if the contracting Education Entity requests us to remove a student's personal information collected, generated, or inferred as a result of the contract, we will destroy the information as soon as practicable after the date of the request unless we have the consent of the student or parent to retain the information. If there is a contract with an Education Entity, we will notify the Education Entity of the date upon which all of the personal information is destroyed.

DATA SECURITY

Your personal information is protected for your privacy and security. Squirrels maintains a comprehensive information security program (including appropriate administrative, technological, and physical safeguards) that is consistent with industry standards and is designed to protect the security, privacy, confidentiality, and integrity of your personal information. Please be aware that, despite our reasonable efforts, no security measures are perfect or impenetrable. While we strive to protect your personal information, we cannot ensure the security of the information you transmit to us, and so we urge you to take every precaution to protect your personal data when you are on the Internet. Change your passwords often, use a combination of letters and numbers, take advantage of multi-factor authentication features where available and make sure you use an up-to-date and secure browser.

THIRD PARTY SITES

Our ClassHub Website may contain links to websites operated by third-parties. Some of these third-party sites may be co-branded with a Squirrels or Squirrels product logo even though they are not operated or maintained by Squirrels. Although we choose our business partners carefully, Squirrels is not responsible for, and disclaims any liability related to, the privacy practices of websites operated by third parties that are linked to our ClassHub Website. Once you have left our ClassHub Websites, you should check the applicable privacy policy of the third party website to determine how they will handle any information they collect from you.

CHANGES TO THIS PRIVACY POLICY

Squirrels may amend this Privacy Policy from time to time. If we make any substantial changes to this Privacy Policy or in the way we use your personal information we will make that information available by posting a notice on this site or by emailing you.

CHILDREN'S PRIVACY

Our ClassHub Website is a general audience site that does not target and is not intended for those under the age of 18. Squirrels does not knowingly solicit or maintain personal information pertaining to those under the age of 18. Children under the age of 13 should not use our ClassHub Website or provide any personal information on our ClassHub Website or to Squirrels. Squirrels does not knowingly collect or solicit, nor does it intend to collect or solicit, any personal information from Children on the ClassHub Website. Any information collected through Squirrels' ClassHub Website will comply with the terms of this Privacy Policy and with all applicable laws, including but not limited to, Children's Online Privacy Protection Act (COPPA) and FERPA. As discussed above in the Data Security section of this Privacy Policy, Squirrels utilizes certain procedures to protect the confidentiality, security, and integrity of personal information collected, including personal information from Children. As discussed in this Privacy Policy, unless consent is revoked, it is assumed that parents have provided consent.

If not, parents can simply contact us to revoke consent and request the deletion of personal information related to their Children.
